Article 74 — Reporting of Non-Serious Incidents and Malfunctions

1. Deployers of high-risk AI systems shall report to providers or distributors any malfunction or incident which is not a serious incident.

2. Providers of high-risk AI systems shall report to market surveillance authorities any systemic or repeated non-serious incidents as part of their post-market monitoring reporting obligations.

3. In order to facilitate coordinated reporting, the Commission may, by means of implementing acts, specify the format for reporting non-serious incidents and malfunctions.
