Market Surveillance and Control of AI Systems in the Union

Article 75 — Market Surveillance and Control of AI Systems in the Union 1. Regulation (EU) 2019/1020 shall apply to AI systems covered by this Regulation. 2. Market surveillance authorities shall have the power to: (a) require operators to provide technical documentation, other documentation, and any information necessary for the performance of their tasks; (b) carry out announced and unannounced audits of operators, including the inspection of premises; (c) access any software, algorithms, models and relevant data used in or in connection with the AI system, including through remote access; (d) require operators to take appropriate actions to remedy a situation of non-compliance. 3. The market surveillance authority may invite the Commission and the AI Office to participate in any evaluation of the AI system.
