Article 88 — Prohibition of Circumvention of this Regulation 1. Any contractual provision, including any agreement or practice, that has the effect of directly or indirectly circumventing the rights and obligations under this Regulation is prohibited and void. 2. Where an operator has placed on the market or put into service a high-risk AI system in a manner that does not comply with this Regulation, those rights shall apply regardless of the contractual provisions.
