Article 38 — International Aspects of Notified Bodies

1. The Commission shall endeavour to facilitate the exchange of information between notified bodies and bodies in third countries which perform conformity assessment activities for AI systems.

2. The Commission may adopt implementing acts establishing the conditions for mutual recognition of conformity assessment certificates with third countries with which the Union has concluded international agreements.

3. Conformity assessment activities carried out by bodies established in third countries may be accepted for the purposes of this Regulation in the context of mutual recognition agreements.
