Penalties for Providers of General-Purpose AI Models

Article 100 — Penalties for Providers of General-Purpose AI Models 1. The Commission may impose on providers of general-purpose AI models fines not exceeding: (a) 3% of their total worldwide annual turnover in the preceding financial year or EUR 15,000,000, whichever is higher, where the provider has failed to comply with an obligation under this Regulation; (b) 1% of their total worldwide annual turnover in the preceding financial year or EUR 7,500,000, whichever is higher, where the provider has supplied incorrect, incomplete or misleading information to the AI Office. 2. In determining the fine, regard shall be had to the nature, gravity and duration of the infringement, its Union-wide character, the size and market share of the provider, the intentional or negligent character of the infringement, and cooperation with the Commission.
