As regards stand-alone AI systems, they should be classified as high-risk when used in sensitive areas covered by Annex III. The rationale is that, taking into account the current state of the art and the existing legal and regulatory frameworks, those areas are subject to significant inherent risks. The classification covers AI used in biometrics, critical infrastructure, education, employment, essential services, law enforcement, migration, and justice. These can have significant adverse impact on rights, safety, livelihoods and access to public services.
