Annex XIII — Criteria for the Classification of General-Purpose AI Models with Systemic Risk referred to in Article 51(2)

For the purposes of Article 51(2), the Commission shall take into account the following criteria when assessing whether a general-purpose AI model has high impact capabilities leading to systemic risks at Union level:

1. The number of parameters of the model.

2. The quality and size of the training data set, including whether the training data set is multimodal.

3. The amount of compute used for training the model, measured in FLOPs.

4. The input and output modalities of the model, such as text, image, audio, video, code, other modalities.

5. The benchmarks and evaluations of the model's capabilities, including on standardised benchmarks.

6. The number of registered end-users.

7. Whether the model has been found to have caused, contributed to, or is significantly exposed to serious incidents in the Union.

8. Whether it has been designated as critical infrastructure under Directive (EU) 2022/2555.
